Collaborative practice

Collaborative is a respectful, interest-based process to deal with everything family law. It is one of the "Alternate Dispute Resolution" options available to spouses in Ontario. Most often, it is used to negotiate issues arising from the breakdown of a relationship, whether it is a common-law relationship or a marriage. However, it is also an appropriate process to negotiate a marriage contract or cohabitation agreement, parenting plans, and even changes to a previously signed agreement.

Mediation

Mediation is an Alternate Dispute Resolution option available to parties in Ontario. Clients can go through the process with or without a lawyer. As the mediator, Camila Motta will prepare a document at the end of the mediation setting out the agreements the parties reached. A formal agreement is then drafted, and after both parties have obtained independent legal advice, it is signed, becoming a binding and enforceable document.

Domestic agreements

Domestic Agreements allow couples to decide their rights and obligations in the event they ever separate. Instead of allowing provincial laws to decide who gets the house, the jewelry, or their retirement investments, the couple takes ownership of their own fate and agrees how property division, and support obligations, will take place if the relationship ends.

Independent legal advice

If you have an agreement already drafted, you should obtain Independent Legal Advice before signing it. That is important to ensure you understand your rights and obligations, and how the agreements terms compare to the usual applicable law in Ontario.

Will and Powers of attorney

Many people cringe at the thought of preparing a Will. They may miss the point that drafting a Will is not planning their death, but planning what happens after they pass away. In effect, to prepare a Will is to plan for the lives that go on when you are not around. A Will allows you to continue to care and provide for your loved ones even after your death.
