Mediation is an Alternate Dispute Resolution option available to parties in Ontario. Clients can go through the process with or without a lawyer. As the mediator, Camila Motta will prepare a document at the end of the mediation setting out the agreements the parties reached. A formal agreement is then drafted, and after both parties have obtained independent legal advice, it is signed, becoming a binding and enforceable document.
While mediation is commonly sought by separating parties, it can also be useful to parties who are negotiating a marriage contract or cohabitation agreement, a parenting plan, or seeking changes to agreements previously signed.
Mediation may be conducted in person or via Zoom. The parties may be in the same room or in separate rooms, which is called "shuttle mediation", where the mediator navigates between both rooms.
